What is the process of new build conveyancing?
The process of buying a new build home involves several key stages, each with specific legal considerations.
- Reservation – Once you’ve found your dream new build, you’ll place a reservation to secure the property. This often involves paying a reservation fee, which is refundable upon completion.
- Instruct a conveyancer – That’s where we come in. We’ll begin by reviewing the property’s contract and checking that everything is in order.
- Property searches & contract review – We’ll conduct essential searches, including local authority, environmental and drainage searches to check for planning restrictions, contamination risks and water access. We’ll also review the developer’s contract to ensure it includes the necessary legal protections.
- Mortgage & finance arrangements – If you’re buying with a mortgage, we’ll work with your lender to ensure all financing is in place. We’ll guide you through any government schemes, like Help to Buy or First Homes, if applicable.
- Exchange of contracts – Once we’re confident everything is in order, you’ll exchange contracts with the developer. This is the formal agreement to buy the property, and a deposit will be paid. Once exchanged, the sale is legally binding.
- Completion – The final stage is completion when the full payment is made, and you officially take ownership of the property. If you’re buying off-plan, the completion date will depend on when the property is finished. We’ll stay in contact with the developer for updates.
- Post-Completion – We’ll register the property in your name and handle any final paperwork. This can sometimes take longer than for an existing property because it’s the first time the property is being registered with the Land Registry. This won’t stop you from moving in, though — you can live in your home while registration is being processed!
How long does new build conveyancing take?

Each new build development is unique and timelines can vary based on whether the property is ready for occupation at the point of exchange.
